Terms & Conditions

Welcome to VOKALZ! These Terms and Conditions (“Terms”) govern your access to and use of VOKALZ, a social networking mobile application (“App”). By accessing or using VOKALZ, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the App.

1. Acceptance of Terms

By using VOKALZ, you represent that you are at least 16 years old and have the legal capacity to enter into a binding agreement. If you are between the ages of 16 and 18, you must review these Terms with your parent or legal guardian and obtain their consent to use VOKALZ. If you are using VOKALZ on behalf of an organization or entity, you represent that you have the authority to bind that organization or entity to these Terms.

2. Community Member Account

  • Account Creation
    To use VOKALZ, you must create a community member account. You are responsible for providing accurate and complete information during the registration process and keeping your account credentials secure.
  • Account Security
    You are solely responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You must promptly notify us of any unauthorized use or security breach related to your account.

3. Community Member Content

  • Ownership
    You retain ownership of any content, photos, videos, posts, comments, or other materials you upload or share on VOKALZ.
  • License
    By posting or sharing community member-generated content on VOKALZ, you grant VOKALZ a non-exclusive, royalty-free, worldwide license to use, modify, reproduce, display, and distribute your content solely for the purpose of operating and promoting VOKALZ. You represent and warrant that you have the necessary rights to grant this license.
  • Prohibited Content
    You agree not to upload, post, or share any content that is illegal, infringing, offensive, defamatory, or violates the rights of others. VOKALZ reserves the right to remove or disable any content that violates these Terms.

4. Prohibited Activities

When using VOKALZ, you agree not to

  • Violate any applicable laws, regulations, or third-party rights.
  • Impersonate any person or entity or falsely represent your affiliation with any person or entity.
  • Use any automated system or software to extract data from VOKALZ without our prior written consent.
  • Circumvent or manipulate any security measures, digital rights management, or other protections on VOKALZ.
  • Engage in any form of harassment, hate speech, or abusive behaviour towards other community members.

5. Wallets & Transactions

When you activate your VOKALZ Wallet and start your transactions, you agree that VOKALZ may communicate with you electronically any important information regarding your transactions or your account.

Payment Credentials

If you make a transaction through VOKALZ, you are bound to provide valid payment credentials.

Transactions & Fees

  • Your top-up transactions on VOKALZ can be done via PayPal, Debit Cards or Credit Cards.
  • Pay attention to the details of the top-up transaction because you will liable and responsible to all taxes, fees, and exchange/conversion fees.
  • Your withdrawal transactions on VOKALZ can be done via bank transfer.
  • Withdrawals are allowed for a minimum amount of USD 200/- per transaction.
  • Pay attention to the details of your withdrawal transactions because you will liable and responsible to all taxes, fees, and exchange/conversion fees.
  • Withdrawals will be done after the periods of 15 business days via wire transfer into your bank account.
  • When you provide a payment credential to us, you confirm that you are permitted to use that payment credential. When you engage in a transaction, you also authorize us to collect and store that payment credential, along with other related transaction information.
  • If your transaction results in an overdraft or other fee from your card issuer due to going over your credit limit or having insufficient funds in your account, your card issuer may charge you a fee, and you alone are responsible for that fee.
  • If at some point we do not support your preferred method of transaction, you can opt for a different type of payment (such as credit or debit card, PayPal or mobile operator billing).
  • To prevent financial loss to you or to us, we might contact your payment credential issuer, law enforcement, or affected third parties (including other community members) and share details of any transactions you are associated with if we believe doing so may prevent financial loss or a violation of law.

Wallet Credentials

You are solely responsible to maintain high confidentiality when it comes to your wallet credentials’ security. You are strongly advised not to share your VOKALZ credentials with anyone, as this will result in disclosing your Wallet and transactions, hence any future transactions that might occur on your account.

6. Intellectual Property Rights

  • VOKALZ Content
    VOKALZ and its licensors own all rights, title, and interest in and to VOKALZ, including its design, features, trademarks, logos, and content, excluding community member-generated content.
  • Community Member Content
    By posting or sharing community member-generated content on VOKALZ, you represent and warrant that you have the necessary rights to do so. You retain ownership of your community member-generated content, but grant VOKALZ a license as outlined in Section 3.2. of these Terms.

VOKALZ is provided on an “as is” and “as available” basis. We do not guarantee that VOKALZ will be uninterrupted, error-free, or secure. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Third-Party Content and Links

VOKALZ may contain links to third-party websites or services. We do not endorse or control the content or practices of third-party websites and are not responsible for their privacy policies or terms of use. Your use of third-party websites is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by applicable law, VOKALZ and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, consequential, or exemplary damages arising out of or in connection with your use of VOKALZ.

12. Indemnification

You agree to indemnify and hold harmless VOKALZ and its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including attorneys’ fees) arising out of or related to your use of VOKALZ or violation of these Terms.

13. Modifications and Termination

VOKALZ reserves the right to modify, suspend, or terminate VOKALZ or these Terms at any time, with or without notice. We may also impose limits on certain features or restrict your access to parts or all VOKALZ without liability or prior notice.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of The United Arab Emirates. Any disputes arising out of or in connection with these Terms shall be resolved through binding arbitration or in the courts of the United Arab Emirates.

15. Entire Agreement

These Terms constitute the entire agreement between you and VOKALZ regarding your use of VOKALZ and supersede any prior agreements or understandings.
